Terms of Service

By accessing or using Formulary ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including those accessing the Service on behalf of an organisation.

Formulary is a formula management platform for perfumers. It allows users to upload and organise fragrance formulas, match ingredients to supplier catalogues, track inventory, generate shopping lists and bench sheets, and record production runs.

The Service is provided on a subscription basis with a free tier and paid plans. Features available to you depend on your current plan.

You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorised access. We are not liable for losses caused by unauthorised use of your account.

You are responsible for all activity that occurs under your account, including activity by members you invite to your organisation.

You agree not to use the Service to:

• Upload or store illegal content of any kind
• Abuse, spam, or attempt to circumvent AI credit limits through automated requests
• Attempt to gain unauthorised access to other users' data
• Reverse engineer or extract the AI models or proprietary algorithms used in the Service
• Resell or sublicense access to the Service without written permission

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

Your formulas, ingredient data, and production records are yours. We claim no ownership over formula data you upload or create within the Service. You grant us a limited licence to store and process your data solely for the purpose of providing the Service.

The Formulary platform, including its design, software, and AI matching systems, is our intellectual property. These terms do not grant you any rights to our technology beyond the right to use the Service as described.

Paid plans are billed monthly or annually as selected at the time of subscription. Annual plans are charged in full upfront. All prices are in Australian dollars (AUD) and are exclusive of any applicable taxes.

We reserve the right to change pricing with 30 days’ notice. Changes do not apply to the current billing period.

Our collection and use of personal information is described in our Privacy Policy, which forms part of these terms.

To the maximum extent permitted by law, Formulary is provided "as is" without warranty of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including loss of data or business interruption.

Our total liability to you for any claim arising from these terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

We may update these terms from time to time. We will notify you of material changes by email or by displaying a notice within the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated terms.
